Board Meeting Minutes
September 28, 2009
Meeting was called to order at 6:34 p.m.
Present were: Beth Lintz, Pamela Johnson, Michael Schleger and Debbie Gordon
Representing Towne Properties was Amy Cain.
Minutes from the August 18th 2009 were reviewed and Beth Lintz made a motion to approve them and have them posted to the website, the motion was seconded by Pam Johnson and all were in favor.
The Board reviewed the bank account information for the association as of September 28, 2009 the balance in the account is $863.53 this account will be kept open for a few more months. A check, for $27,687.13, was sent to the new management company and placed in the new bank account with Commerce National Bank. Since the PO Box & Bulk mail is already paid for they will be in use for one year. 
An overview was given of the expenses for AEP, City of Columbus Water / Sewer Division. A budget will be drafted for the coming 2010 year. Towne will be providing financials and a delinquency report. Pam Johnson will provide Towne Properties with record of past due balances, attorney fees. Their was a brief discussion of how to proceed with respect to the owners with a past due balance to lien or file with the small claims court. Amy advised that you can proceed either way. However a lien will stay with the property and small claims only against the property owner. If a lien is in place then when the property could not be transferred until the lien is satisfied. At this point the association could send a letter to those past due and give 15 days for them to pay or make arrangements to pay. If the owner does not comply then anyone with a past due account should be sent onto the attorney for legal letter. Keep in mind that all legal expenses would be charged back to the owner.
The board members reviewed the most frequent concerns with the lawn maintenance at foreclosure homes and/or vacant homes, abandoned vehicles, parking concerns on streets and aprons, pet waste and leashing of pets. All of which fall under city ordinances. The board has directed that owners with such concerns report them to the city. A reminder could be sent to the owners through management but the overall impact may be greater if it came from the city.
Deed restriction infractions will be inspected and owners will be given a deadline of remedy. The overall goal will be to keep owners informed and educate or clarify anyone with questions regarding deed restrictions. The present board has invoked the “Business Judgment Rule” with regard to modifications.
The entry beds will continue to be maintained by Paul Dobner as the board directs. The board informed Amy that the Irrigation system is off and the meters for them have been removed, which can be reinstalled if need be at a later date. Mike has devoted much of his personal time over the last several year as well as previous years to mowing the entries, clearing of culvert and hauling debris off to help save in costs for the association. Beth Lintz made a motion to give the computer that was used years ago Mike Schleger as a token of appreciation for his years of service to the association. The motion was seconded and all in favor.
